Legal Question in Workers Comp in New York

hurt at work???

My wife bumped her head at work it did'nt seem like a problem so she did not fill out a report(her co-workers did witness the incident).

Later that week she had a problem with double vision in that eye and is currently seeing a doctor to find the cause of the problem.

She seems to think she has given up all her rights having not filed an injury report the day she hit her head.

If the doctors findings point to the bump on the head,does she still have rights concerning an on the job injury??

You have my sympathies for the concussion. I hope no permanent damage was incurred.

The lack of a report at the time of the incident is only one piece of evidence. Your friend has to show some evidence that the injury happened at work. The testimony of co-workers is completely sufficient. In addition, the employer may not contest the claim, making the lack of an immediate report irrelevent.
