Legal Question in Workers Comp in New York

workers comp increase

I classified in 1998 and receive regular weekly payments. Do these payments ever increase (ie: cost of living) or will they always be the same?

Unfortunately for you (and many who are in similar situations) your wages for Workers Comp are based on the amount of money you earned during the 52 weeks prior to and leading up to your accident date. That amount is the only thing that affects your payments and therefore, the payments will never increase.

Unfortunately they never go up. No matter what the cost of living increase is nationally, your comp payment is locked.
