Legal Question in Workers Comp in New York

Workers' Compensation Schedule Loss of Use

I have a schedule loss of use of 50% of my wrist. If I looked in the correct place, I believe I am entitled to 300 weeks. How is the settlement amount calculated and how long does it take to receive payment?

It depends. Please give me some more details and let's discuss. Do you have another accident on the same site of injury? How much comp were you previously paid? etc.

Re: Workers' Compensation Schedule Loss of Use

A 50% SLU of the hand (wrist) equals 122 weeks of benefits. If the injury is to the thumb ( better known as DeQuervain's Tendonitis) it is only worth 37.5 weeks. There are add ons if you were out of work for more than 32 weeks at total disability known as Protracted Healing and also ongoing awards after the schedule is paid under Section 15(3)(v). Both of those issues typically require some more experienced knowledge of the compensation law so I would not recommend trying to "go it alone"
