An LLC can be represented by the owner in Small Claims court, but not at any stage above that. The limit is $5,000. Unfortunately, in small claims court, you cannot sue an out of state defendant, you have to file suit in the county where the defendant resides. In order to get jurisdiction over an out-of-state Defendant, you would need to file in District Court and would, unfortunately, need an attorney. Does the contract provide for attorney fees?
