Legal Question in Criminal Law in North Carolina

My boyfriend is charged with two counts of statutory rape. However he was under the influence of prescription drugs and alcohol and passed out. He woke up and the 15 yr old girl was on him. He stopped it but because of her threatening him by saying she would say he raped her, he didn't tell anyone. The next night after laughing and joking with him and asking him to help do chores, she said he raped her. He contacted his doctor about the way a new medication was making him pass out and many witnesses to this. Along with the girl had made several accusations about other people saying and doing things before. Would he have a chance at being found not guilty in trial and what can we do to help him. The girl has been known also to steal her step mothers sex toys, caught as young as 9 years old having sexual relations with other girls, has been in a sexual relationship with an 18 yr old girl since she was 14 yrs old, and drilled a hole from her wall into the bathroom with a sharpie marker to see guys when they stood up in front of the toilet. Other disturbing behavior as well but too much to mention.

your boyfriend should have been appt'd counsel...if you aren't satisfied with that attorney, i suggest you get a 2nd opinion...most attorneys will not charge for a 2nd opinion as long as you get the file from the 1st attorney...it is not appropriate for attorneys to advise folks that are already represented...this is a serious matter which involves mandatory jail time, so i suggest you make certain you are satisfied with the attorney...sound like this case is going to trial...is your boyfriend out of jail or was he unable to post bond? You may contact me directly as long as you are asking the questions...i can't speak to your boyfriend if he is represented unless you get his file...good luck
