Legal Question in Criminal Law in North Carolina

Car sold, person took possession from my son who is not the titled owner. Reduced the price and had my son sign a paper. I am requesting the monies agreed upon before handing over title. Also took vehicle off my lot without permission, will not return or pay an is threatening to take to the crusher. Do I have to take to small claims court?

No you do not have to take it to small claims Court. However, of your options, that is one of the better legal options assuming the other person is solvent and can be served. Of course if the car was taken without your permission then you may be able to report the car stolen to local law enforcement and let them deal with it.
