Legal Question in Criminal Law in North Carolina
Charged will incarcerated.
In 98 I was incarcerated. will i was in jail, i got a failure to appear because i was not taken to court. I was not aware of this until 10 years later when i tried to get a motorcycle license and was denied in California due to a hold up in North Carolina. When i called they said it was a failure to appear. After hour of research with my wife and mother, we have come to find out that the public defender is no longer with the state. I am unable to go there myself and have no money to hire an attorney. Does anyone know how i could possibly get this cleared ASAP?

I find it hard to believe that North Carolina would have no system to provide free legal services to criminal defendants who are indigent. While they might not have public defenders the way we do here in California there has to be some way courts there find and appoint attorneys for those who cannot afford them. I would do more research on this issue. Get on the phone and start dialing around. Call court clerks and private attorneys in the area.

You get it 'cleared' the same way anyone else would have to: you either appear in person in the court that issued the warrant, or you hire an attorney to appear for you. If you qualify for the public defender there, one can be appointed by the court at your first appearance; the court will not do so until you appear. You might be able to find an attorney for pro-bono or indigent clients by contacting the local bar association there.
