Legal Question in Family Law in North Carolina
Me and my ex GF had a son out of wedlock, about two years ago she moved to KY, I went with her but had to come back to NC, she drops me off and says I will see you in two weeks it's almost been 3 years and that's fine as far as she goes, but I want my son, we had a super relationship and she knows that, I have emailed her several times and never get answer, she is not a good woman she lost her 14yo to her ex and has only went to see her one time in year and half, last week I get in mail a calender call here in NC with us listed it said for Child support and custody, well I been paying CS to the state of KY for 2 years so not sure on that and she knows she automatically has custody since out of wedlock so it's weird, so I am wondering since she is coming here for that can I in return go for custody of our son or do I have to go to KY? Also, she was arrested last July for shoplifting, even her ex-said with all he has on her and that info it would be hard for the court to let her keep him. So I am wondering how I should handle this, if I can go for custody here in NC since she is.

It is possible someone other than the mother is going for custody. You don't say what your involvement with the child has been in the last 3 years. If you have had limited or no involvement other than paying child support - expect to have an up hill battle. When it comes to Court, most of your focus shouldn't be why she shouldn't have custody - it should be on convincing the Court why you should. Regardless, you need an attorney if you are serious about gaining custody. Best of luck!
