Legal Question in Family Law in North Carolina
My husband was summoned to attend a hearing for the court to order a paternity test. It is a child from a girlfriend he had 5 years ago and never knew about. Apparently the ex girlfriend lost custody of the kid. Her mother now has custody and is suing for a paternity test and child support. Is there anything we need to do before or when we go to the hearing? He had no idea that this ex girlfriend had a baby after they broke up and we’re finding out about this right after the birth of our second child, so have no idea what to do or what options there may be.

All that matters is whether he is or is not the father. Whether he had any idea or not is irrelevant. So essentially all you can do is keep your fingers crossed that he is not the father or child support is gonna pinch him fairly hard. Of course, if he is the father he can always make life tough for the old bat grandmother by counter suing and forcing visitation and possibly for some sort of emotional distress if they intentionally kept the fact that he may be a father from him.
