Legal Question in Civil Litigation in North Carolina

A person that I know got into an altercation at a bar. A physical confrontation occurred outside the building / bar. My associate was not injured but the other party was. This happened approximately 3 months ago. Around one week ago, a person that was with the injured party at the bar on the night of the altercation. Approached me , asking me my name & stating that his friend was hurt. I stated to him that " I never touched his friend." Now, I have been told by a couple sources. That the person injured is looking names for a Lawsuit ? " what should I do ? " , " how should I handle this ? " I absolutely did not touch or harm this person at all. I am good friends with person possibly responsible ? And, I do not want to be.caught up in a lawsuit ? What should I Do ?

Do not talk to anyone about this incident; especially your friend. If someone is going to file suit against you, they are going to do it. All you can do is mind your own biz and wait. If they file suit for an intentional tort, they have to file within one year of the date of incident/damage.

The only person that you would talk with about this matter should be an attorney. You probably will not need to do that until they file against you (assuming they do); but my guess is they are trying to get you on record so they could possibly use you as a witness. You can always seek the advice of a good lawyer to ease your concerns....good luck.

Rule 11 of the Civil Rules of Procedure requires attorney's to have a good faith basis for filing a claim, so if what you say is correct, that Rule may serve to protect you.
