Legal Question in Immigration Law in North Carolina
To make a long story short. I meet this girl 2 years ago (she's Philipio) and at the time she had a valid working visa. 3 months after we meet her employer did not renew her visa. I would like to ask her to move in with me, but I am not sure what I can do to get her a valid visa.
She's talked about going back to school, and that would open the door for an educational visa.
But right now I am not sure what my options are.
Thanks for any advise.
Jon.

Jon,
The answer to this question lies in the type of visa she entered and the code of entry given to her by the CBP officer on her I-94. Feel free to contact me with said information and we can discuss further.
If you plan to marry her (not merely move in together) and you are a US citizen, then she might be able to correct this situation and become a permanent resident (get a green card). Otherwise, there are no other realistic options IF her I-94 had expired and she has been "out of status" for about 2 years in the United States.

You can apply for permanent residence on her behalf if you are a US citizen and get married to her.
