Legal Question in Immigration Law in North Carolina

my mexican husband and i got married in 2001. i am a us citizen . he was deported in 2005 applied for a k3 visa and was granted one. now he has a green card. his son is here illegaly and wants to become legal. he was 17 when we got married. does he have to go back to mexico to become legal or can we do it here.

If he came to USA illegally and nothing was ever filed for him in the past, then, yes, it seems that he will have to go back to Mexico to apply for a visa. Have you petitioned for his son back in 2001?
