Bogus Seat belt ticket in Locust Nc

I was In the Passengers seat wearing my seatbelt @ 10:30pm on a 4 lane road when and officer pulled us over. He stated that the reason he pulled us over was because I was not in a seat belt. I had been wearing it the whole time. He wrote me a ticket anyways. I saw him pass us by right before he pulled us over and he was on the otherside of the 4 lane At 10:30pm. I showed him the belt was indeed fastened but he was not hearing it. Can I subpeona the dash cam video as evidence and wear his rookie but out in court? And if I cant do this what are the ramifacations for just paying the ticket? Would I have any points added to my insurance or drivers license? This is the first time I have ever recieved a seat belt ticket because I always wear it. I dont know what the best course of action would be here.

There would be no points so no real consequences. At the same time, if you want to spend the time, you have nothing to lose by fighting it (except your time). You'd have to ask the DA about getting the tape. You can call the other occupants of the car as witnesses.
