Legal Question in Workers Comp in North Carolina

injury caused over time by type of work

North Carolina. My aunt has in the past year and a half had some problems with shoulder/arm pain. She had surgery to help this. She was out of work recently because she is in so much pain that she couldn't tolerate the type of work she did (lifting and lots of arm/shoulder repetative movement over 16 years of employment there). Two weeks ago she quit her job due to this. I told her that she needs to see an attorney and she says that there is nothing that can be done. Her injury progressed over time so there is no accident report, but the injury correlates to the type of work she did. Is it too late for her to do anything legally about this?? She is currently looking for another job. Will her going to work at another job affect this? And since she is not longer employed there is there no way that she can get workers comp?

Re: injury caused over time by type of work

She has a workers' compensation claim for an occupational disease caused by repetitive motion. She should call the NC Industrial Commission ASAP at 1-800-688-8349 and file a Form 18 before the statute of limitations runs. She will need an attorney, so get one involved early.
