Legal Question in Family Law in North Dakota

dental or orthodontic bills

My husband was previously divorced back in 97. In the divorce papers it only talks about having to carry Dependent health insurance on his daugther and if the health insurance doesn't cover everything they are supposed to split the non-covered health care expenses equally. There is no where in the divorce papers that talks about dental coverage. Now his ex is coming to us asking us to provide dental insurance and pay for braces. We have went ahead and taken out dental insurance for his daughter but the dental insurance only covers so much for orthodontics/braces. Since the divorce papers only state he has to carry health insurance and pay half of any non-covered health care expenses does that also include any dental or orhtodonics she has? Are we required to pay for half of the outstanding balance on her braces? Thanks for any advice you can give.

Re: dental or orthodontic bills

Based on your question, you would not have to provide dental insurance. However, non-covered health expenses (orthodontics) must be equally divided.

If you are providing dental insurance, then unreimbursed health expenses for the braces must be equally divided.

Mike.
