Legal Question in Business Law in Ohio
Playground Disaster
I own a preschool- we just opened in July 08. We ordered a $50k playground with surfacing from a company to be installed by July 11. Long story short, there were errors made on their part, the surfacing is not what I ordered, during the past 5 months it has been unsafe for children to play on and therefore often unusable and it is FINALLY finished, however its going on 5 months late.
We owe $25k to this company, and I do not think its fair to pay the remaining amount due to poor workmanship, failure to deliver on time, and my overall complete disatisfaction with the entire set.
Do I have a legal leg to stand on?

Based on the limited information you have given, yes. I would have to review the contract itself, and inspect the surface (or at least see photos). In addition, you may have off-the-contract equitable remedies available. This sounds like it is worth pursuing bc, at a minimum, you may be able to reduce the debt owed, if not avoid it altogether.
