My aunt was placed in a nursing home several years ago. She is on Medicare and Medicaid. Because of getting medicaid assistance when her home was sold she had to turn on money over to the state. We returned her used car to the bank and explained our situation. We sent proof of medcaid assistance and the need for nuring home. The car was auctioned off which left a balance of 2000.00 owed. She called and explained at the time that her home was sold and monies turned over to the state. She has no bank account and receives 40.00 per month to live on from Medicaid. A collection agency is now threatning her with a law suit three plus years later. How far can they take this since she has nothing,is 80 years old and is in poor health. She has on POA and is responsible for her on business. Thank You

Your aunt is basically judgment proof. The monthly allowance she receives is exempt from attachment by creditors. There's nothing to get.
