Legal Question in Credit and Debt Law in Ohio

Common Pleas Court

I've been summoned to Common Pleas court regarding a debt with MBNA. I dont ever recall receiving a credit card in the amount that they are charging me for and when I met the lawyer the first time in court, he couldnt provide any documentation as to when the CC was signed for or anything like that. What happens at this stage and what would be the best course of action for me?

Thanks

H

Re: Common Pleas Court

What you should do at this point is initiate what is called the discovery process to try and obtain any documentation MBNA has to establish that they you owe what they are requesting in the Complaint. The discovery process is a process by which you formally request that certain documents pertaining to your matter be made available to you for review. My suggestion would be to contact a law firm to assist you with this and in trying to settle this matter with MBNA because a firm will have the knowledge of what to request and the negotiation techniques to hopefully settle this matter. Feel free to contact our firm. We practice in the area of debt collection throughout the state of Ohio.
