Legal Question in Credit and Debt Law in Ohio
I just found out today that I'm being sued for credit card debt in the amount of $1700.00, with the court costs they said it would be around $2000.00. I'm not employed, my only income is child support. I'm married and my husband works but he pays child support for his 2 kids. They are getting ready to serve papers to me for the court date. Needless to say, I don't have the money to pay the debt...not in full or in 2 payments or even the settlement amount of $850.00. My husband and I have a joint checking account that we only use to pay our car insurance. There is no other money or accounts of any kind. We also own an older car that my husband uses for work. The vehicle is in my name only, but my husband paid for it. We have no other assets. I live in Mansfield, Ohio. So my question is when the court date happens and they put the judgment against me will they be able to take my car away? I do have a seasonal job, but I didn't tell them where it was. My employer is out of another state. Is it likely that they will find out where I'm working and garnish my wages or attach our bank account? Like I said, I don't have any other money or assets....the car is probably worth about $500.00 and the only money I put in my bank is to pay the insurance on the 3rd day of each month. Also, if they attach my pay, how much can they legally take from me each week? Thank you for your time in this matter!

You might want to file for bankruptcy, especially if you have more debts than just this one. A Chapter 7 Bankruptcy can discharge most debts.
