Legal Question in Credit and Debt Law in Ohio
Pension
My brother had a stroke 5 years ago and only receives a small pension from the railroad. A collection agency has called and threaten to garnish his checking account. This is his only source of income, can they do this? If so, couldnt he close his checking account and get his checks sent directly to him instead of direct deposit.

Re: Pension
A creditor cannot garnish a checking or savings account if the only money in the account is from a pension. Pensions, with very few exceptions, are exempt from garnishment by creditors.
