Pension

My brother had a stroke 5 years ago and only receives a small pension from the railroad. A collection agency has called and threaten to garnish his checking account. This is his only source of income, can they do this? If so, couldn�t he close his checking account and get his checks sent directly to him instead of direct deposit.

A creditor cannot garnish a checking or savings account if the only money in the account is from a pension. Pensions, with very few exceptions, are exempt from garnishment by creditors.
