Legal Question in Criminal Law in Ohio

falsely accused of felony

My boyfriend was going to do a job for this gentleman. The gentleman gave a check for the amount of the materials. We got materials and dropped them off with his receipts. When we showed up to start the work. He came to the door, told my boyfriend he was going to hire someone else,my boyfriend told him that was his choice, then the man closed the door on him. Later, we got a call saying there was a complaint from the other man. He said he paid for services he never got. We explained he only paid for materials, not services,if he wanted his money back we needed the materials and receipts so we could get our money back. We made several attempts to to speak with the detective but every time he told us to come in,he either had to leave or was already gone. After awhile of not hearing anything,we thought the man had dropped it. 3 years later,my boyfriend was arrested for ''5th degree felony''. I was a witness that it was not true, but when you get arrested, your name goes in the paper and what you were arrested for. Now people that know us are thinking terrible things. We can't afford a lawyer and have to use a defender. This is like defamation of character. It can cause problems if he tries to get a job or something. What can we do?

Re: falsely accused of felony

All of your arguments are good, but they cannot stop the actual indictment. He needs to tell his lawyer off the bat that he's going to trial...that way the p.d. will be prepared from the beginning to do so.
