Legal Question in Criminal Law in Ohio
felonious assault
I actually have two questions. Would two domestic violence cases seven years apart, in different states constitute a felonious assault? Can you please give me the exact definition of felonious assault? thank you for your time. I will probably have additional questions when these are answered.

OHio elements of Felonious Assault: KNowingly cause serious physical harm to another or to another's unborn child (or) cause or attempt to cause physical harm to another or to the unborn of another by use of a deadly weapon or dangerous ordnance.
THe second DV charge is charged as a 5th degree felony instead of a 1st degree misdemeanor because it is a second offense of similar type.
