Legal Question in Criminal Law in Ohio
Sealing or expundging an Assult Felonly
Can we expundge an Assult charge from 1996? He pleaded guilty. He has no other charges except for a DUI in 1995. We need to know if it's worth a try. Thank You.

Because you have two offenses (assault and DUI) you are not eligible to have either one of them sealed. Expungment and sealing of the record are the same thing. You are not eligible under Ohio law.

Also, even if he didn't have the DUI, an offense of violence that is a felony is not expungeable.
