I was arrested for drunk driving and yes, I was drunk and blew a 0.3 bla. I wrecked my car and then arrested. The court warned me that my car could be seized. I decided and was allowed to take the car to a body shop have it repaired and after the repair it would be towed to my house and then it would be immobilized for 90 days, and then at my final court date it would be decided if the court would seize the car or not.
The body shop totalled the car and my insurance company is giving me $7000.00 for the car. As the car sits it is worth $800.00. Before my car was wrecked I went to a car dealer and they was going to give me $4500.00 for a trade in. If the court decides they want to seize my car, how much money are they allowed to ask for? And if they do want all my insurance money can I fight it?

I have never heard of a case where the court was allowed to take your insurance money. They can take the car, but unless there's some new rule that allows them to take the proceeds, then keep the whole insurance money thing between you and your insurance company, not the court....
