You or your lawyer can file a motion...if this is for a dui arrest, then you cannot drive for 15 days...if you refused the breathalyzer then you have to wait 30 days....
the only way out of this is to file a motion that says that the officer didnt have sufficient reason to ask you to submit to the breathalyzer.
once the 15 or 30 days is up, courts generally liberally provide driving privileges for occupational, medical, educational and family visits..
