Spousal rights versus Power of Attorney
I have Durable POA for my elderly, dementia mother who is in a nursing home. My elderly father is still alive in an assisted living. Does he or I, as POA, have legal responsibilities to sign medicaid applications and care for her.

When dealing with Medicaid issues it is very important to know the impact of applying for Medicaid before the application is completed, as it will affect both your mother and father both personally and financially.
Before anyone files a Medcaid application, I strongly reccomend speaking to an elder law attorney. Feel free to email.

either one. My question is do you have a durable power of atty for health care. this give you much greater authority. If it is not done yet, due to you mom's condition it is probably too late.
