Legal Question in Family Law in Ohio

Abandonment

My ex-wife has not called or picked up my son on scheduled days for 6 weeks. Is this abandonment? Do I have to let her take him? What can I do?

Re: Abandonment

In a post judgment situation, abandonment really has no force, although her conduct could be a factor if you are seeking to restrict her visitation even further. There is nothing in Ohio law that requires a non-residential parent to exercise visitation. You are only required to make the child available at the appropriate times.
