Child Custody Rights
I moved to Colorado 2 years ago when I got married.When I moved I wasn't allowed custody of my son.He is under his fathers custody.I am often denied my parent priveledges being...phone calls..etc. Also my son is telling me the horrible things going on at his fathers.He(my son) claims child abuse almost every week I talk to him.He is being left home alone at 9 years old.Is there anything I can do to get custody of him.I will get him for the summer and he wants me to promise NOT to take him back there.Can I file for custody here in Colorado even though he lives in Ohio?

My name is Alexandra White and I am an associate with The Harris Law Firm. Since the child resides in Ohio, the Ohio Courts have jurisdiction over issues relating to parenting time. There are some circumstances where a parent can ask another state to take emergency jurisdiction if the child is in danger. For example, if he visits you in Colorado and tells you that he is being physically abused by his father, you may be able to ask the Colorado court to take emergency jurisdiction.
