Legal Custody vs. Guardianship?

I have a step-son who is the legal custody of his mother who resides out of state. She has decided that she wants me and my husband to have guardianship over the 16 year old minor. She is having an attorney in her state draft the paperwork. We are willing to take the minor and we want to know how this affects child support. She suggested that she would just ''refund'' us the money but I question her intent and feel it needs to be done legally. What do we do?

Contact the child support agency handling the payments and ask this same question to them.
