Legal Question in Family Law in Ohio

Ok here's my question. The wife abandonded the marriage and moved back to Ohio from South Carolina in Jan 2010. I moved back to PA in Apr 2010. We have been separated since Jan, but no paperwork was filed. Now she is in the ICU, in critical condition. Being that I still am the legal married spouse. Do I still make all the decisions on her treatment and what I think would be best.

Did your wife execute a health care power of attorney or living will? If so, that would mention who she nominated to make these health care decisions.

If she doesn't have a health care power of attorney or living will, then the process is to go to court to get the authority. Read these statutes for guidance. http://codes.ohio.gov/orc/2133.08
