Legal Question in Civil Litigation in Ohio
Petition of Discovery
Could you direct me where I can find Ohio's laws for filing a ''Petition of Discovery''? And what is the difference between this and a ''Subpoena''? I am trying to obtain documents from a company and they won't release them until they receive signatures from the people involved, the people involved are refusing to sign. Those documents are an important determination if I proceed with filing a lawsuit. Thanks

Re: Petition of Discovery
I think you are asking about filing a complaint for discovery. You can review the Ohio Civil Rules. It is essentally a complaint that will be filed with the clerk of courts.
Re: Petition of Discovery
You cannot use a subpoena or a letter for discovery until you have filed the lawsuit. You need to be very careful as to not put them on notice as to what you are looking for so they are not able to destroy it.
