Affidavit of Support question

I am a petitioner for my sister's family and my brother's family at the same priority date: Mar. 26 1999, but at the end of last year, I was laid off from my old job. Now, my new job's salary is much lower than before. I know my current income does not qualify for 2009 poverty guidelines 125%, since my income is low, but can I use my Assets to make up the remaining amount of my Affidavit of Support?

Yes, you can use your assets for the purpose of submitting the Affidavit of Support.

However, your income and assets are valued differently. Value of the assets does not count 1 by 1, but you have to multiply the difference by 5. (e.g. if your income is $10,000 below the poverty guidelines, you need to show $50,000 in assets to supplement low income).

Also, if you are the only sponsor sponsoring your brother, his wife, children, your sister, husband, children - your household size will depend on the number of persons sponsored.

You may also use a joint sponsor (any US citizen or lawful permanent resident).

In conclusion, you will be required to submit the affidavits only when the priority dates are current and as requieted by the NVC.

Yes, you may use your assets, but make sure they are able to be liquidated without tremendous delay. List down things like Equity in real estate property, jewelry, cars, stocks, anything of value that could be turned into cash. If USCIS finds that your income plus your assets help you make the poverty guildeine threshhold, that is good! If not, you will need a joint signer to help. Good luck!
