Legal Question in Immigration Law in Ohio

Deportation and Marriage Dissolution

Wife's visa status is based on her I-485 case which is Pending, but the marriage is a bust. If she loses me as her I-485 sponsor, how long does the deportation process take? Would she have enough time to switch to a corporate sponsor (H1B?) for her career? If deported, how difficult is a divorce (no kids; married 18 months). Alimony? Would I be responsible to ship her stuff all the way back to her homeland in Asia?? This would cost tens of thousands in shipping costs.

Re: Deportation and Marriage Dissolution

If you tell USCIS that you are withdrawing your sponsorship, they will terminate her I-485 within 30 days after they receive your withdrawal letter. She must leave immediately. She cannot change to H-1B status within the U.S. If she could change to H-1B status, there are no more H-1B visas available until October 1st unless she holds a Master's degree or higher from a U.S. university.
