Domestic Violence & Upcoming i 751 application
Hi,
I was accused and convicted of misdeanor domestic violence (sentenced 8 months probation), the case is under appeal. My green card is up for renewal in September, but i am affraid that I might be asked to leave the country. I have 2 childrens 4 months old and 2 yrs old, the incident happened a month after my wife delivered our second child. She was later diagnosed with depression. What are my chances of getting my green card renewed ? please advise.

Yes, it will affect your I-751 petition to remove conditions. I understand that you are an abuser, and the abused is your US citizen wife.

The answer to your question is not simple. The primary inquiry is in what state were you convicted. The next inquiry is under what statute were you convicted. Depending on the statute and your actions, you may be subject to deportation. Additionally, depending on the potential length of sentence you may subject to mandatory detention.
Prior to filing your I-751 petition or engaging in any other course of conduct with CIS, hire an attorney to represent you.
