You can't file until you have a final divorce decree. When you file your petition as as a waiver, you will still have to prove that the marriage was bona fide. If filing after divorce, wife's signature is not required. However, it's a much harder case to win. Please keep in mind that the petition must be filed timely within 90 days prior to card's expiration, or could be filed earlier right after divorce.
