Legal Question in Immigration Law in Ohio
My girlfriend is an illegal alien from Mexico. I am wondering if it is possible for her to become a legal citizen if we were to get married? If so, what will the requirements be? If not, would it be possible if she were to return to her country first? thanks.

Sometimes is can be possible. The main questions are: How did she come to USA (on a visa or without)? When did she come? Had she ever been arrested or stopped on the border while crossing to US from Mexico? Had anyone ever filed an immigrant petition for her?

The answer is likely yes. Whether she will have to return to Mexico or not depends on a few factors. Even if she must return to Mexico, she may be a good candidate for a 601 waiver of unlawful presence, thereby allowing a waiver of the 10 year bar and providing for a relatively short stay in Mexico. My office is located in the Greater Cincinnnati area, and would be happy to discuss further.
