Legal Question in Immigration Law in Ohio

Could my husband get permamently barred from the US after he got caught back in 2001 crossing the border and got in immigration, and then came to the us, then got caught again in California last year, applied for a voluntary departure, and it got granted, went back to Ecuador, and I married him, came back here, and trying to get his green card, can he come back here?
