What long-term non-immigrant visa you plan to apply for, a student visa?

Yes, a person on a student visa will be considered a foreign student until they become a permanent resident or adjust status.

If married to a US permanent resident and then apply for any non-immigrant visa, it could be viewed that a person has an 'immigrant intent', which is not appropriate for a non-immigrant visa. A strategy and planning are required. For that matter, you may want to schedule a paid consultation with any qualified U.S. immigration lawyer.
