I was wondering what an F1-Visa Student that has married a USA citizen needs to do, in order to begin the filing process for an Adjustment of Status and the Work permit.

A foreign student married to a US citizen and residing in USA, can apply for adjustment of status (Green Card), provided that he/she is petitioned and sponsored by his/her US citizen spouse.

You should hire an attorney to represent you. The marriage alone does not confer status on you and you may not be admissible/eligible. There are many criteria of eligibility that need to be met prior to filing. Additionally, you will need to prove the marriage is not for an immigration benefit but is for other bona fide reasons.

Our office routinely prepares and files the paperwork and evidence in these cases. We will also prepare you for and attend the required interview with you. Consider retaining an attorney who will do the same for you.

You will need to file what is commonly referred to as a one step which includes the petition filed by the US citizen spouse and application for green card, work permit and travel authorization. There is a lot of evidence you must also submit to prove that the marriage is real and not just to get the green card. Please contact us by email at [email protected] for more information. We have over 20 years experience in handling these types of matters and our consultation is free.
