fair amount to be paid
I was rearended in an accident last year. Yesterday her ins. man called me and suggested an amount to be paid and said that from that they are going to pay my ins. company what they are do and I will recieve what is left. Is that right for them to do and what is a fair amount for me to be paid for pain and compensation? How do they decided that?

It's nearly impossible to advise you of what is fair based upon the facts you have given. I need to know the nature and extent of the accident and your injuries, the amount of your medical bills and whether you have permanent impairment, either physical or vocational.
Typically, the insurance company doesn't have your interest at heart. What the adjuster has offered is likely much less than what a decent attorney can recover for you. It sounds like they are going to repay the PIP/Med claim that your insurance has against them, and then give you a little bit for your pain and suffering.
