Legal Question in Insurance Law in Ohio

I am the OWNER and BENEFICIARY on my x-husband's life insurance policy who just passed away - insurance company giving me grief. I thought the OWNER controlled everything. I kept this policy to make sure my sons would have some kind of inheritance. Is the insurance company just giving me the run around? Faxed them my divorce decree and marriage license and they're still waiting. What do ya think?

What you have faxed the insurance company is useful, but the key document is the designation of beneficiary, where your ex-husband named you as the person to receive the policy proceeds. You should remember that a designation can be changed, and some people do that after a divorce. The other item is that some divorce decrees deal with the issue of who remains as beneficiary, and prohibits/allows the parties to make changes. While the insurance company may be stalling, they might also be careful in making sure the right person gets the proceeds. Giving them the most recent designation might assist the process.

There has to be a reason for this. Often times, once a couple divorces, the policy designations are changed without the now ex-spouse being informed. I would ask the insurance company for a written explanation for the delay.
