Legal Question in Insurance Law in Ohio

What do I do now????

I was recently involved in a rearend collision which totalled my truck I owned only 6 days. The other driver was sited and his truck was impounded due to improper plates and was insured. The ins. co. didn't get me a car until 12 days after the wreck. They aren't willing to give me replacement value for the truck. I denied their settlement and they got angry and took away the rental. They sent me 40 trucks listed for the amount but it wasn't for the type of truck I had. My temp. tags are about to run out and I have had to make the first truck payment and ins. payment on a vehicle that is totalled. Why am I to take the punishment for something that was not my fault. What the heck to I do now that the adj. is pissed and won't return my calls. If I obtain a lawyer, it will defeat my purpose of getting what I deserve for the truck because they will take 1/3 of the money. The personal inj. case won't be settled till I am released from my doctor. Help!!!!

Re: What do I do now????

Many attorneys, myself included, do not take any of the property settlement proceeds. The insurance company may be acting in bad faith. Get the exact documentation on your vehicle and present them with replacement value from 2 or 3 dealers of that vehicle. Present this info to the insurance company and if they don't settle, you may need to sue them. Feel free to call with any questions. Good Luck. 859-491-5800.
