Sometimes, but not always. Discrimination laws, including state law and the Pregnancy Discrimination Act prohibit discrimination on the basis of a pregnancy and the FMLA provides maternity leave with job protection in certain situations (e.g., must be an eligible employee and the employer must have 50 or more employees). Whether any of these laws apply to your particular situation, however, and if so, whether they have been violated, depends on many, many facts, none of which are stated in your post. If you think that your employer discriminated against you on the basis of a preganancy or for taking materinty leave, you should consult with an attorney promptly as strict statutes of limitations apply.

The guarantee is the highest form of contract. So my answer as to that is No. However if your on approved maternity leave then you should receive a job or position similar to the one you had prior to the leave.
