Misclassification of Employment
I am an assistant branch manager at a credit union. I have been classified as ''exempt'' under the Fair Labor Standards Act & receive no overtime. The branch that I work in is particularly small and I find that the majority of my time is taken up by ''production'' work--opening accounts, loans, IRA's, etc. Between these ''production'' duties (in which others get paid hourly to do) and my managerial duties, I often find myself working up to 50 hours a week. I am leaving my job May 15th, but would be interested in filing suit to retain fair earnings. How must I prove that the majority of my time was spent doing work that others were paid hourly to do?
