Legal Question in Legal Ethics in Ohio

Professional Responsibility

It has been four months past the signing and filing of the dissolution and My attorney has still not even started the Qualified Domestic Relations Order to take funds from my 401K to pay off the ex's house as agreed. My lawyer was paid in full up front. I have called at least a dozen times to get him moving on this and, until the last two calls, I have been very pleasant and patient. What recourse is at my disposal to either get him moving or burn him?

Re: Professional Responsibility

I can understand your frustration. I would recommend that you call the attorney, schedule an appointment, and then, at the appointment, explain why you are upset. I do not practice domestic relations law, however, I do know that QDRO's are very complex documents. Many very good domestic relations attorneys will hire a company to prepare these documents, they are so complex.

In any case, the attorney owes you the courtesy of an explanation of why there has been such a delay. If he refuses to meet with you, then you can always file a complaint with the bar association.
