I recently sat in a Martha Stewart Chaise Lounge Chair that was bought at a K-mart in 1999. When I sat down the bottom of the chair amputated the tip of my finger.I have lost work and the hospital was not able to re attach the tip. It is very ugly and will need plastic surgery. Who should I contact? The company who made the chair or K-mart.

You may have a product liability claim against all in the chain of commerce that sold the chair. A complete workup of the damages, current and future, is necessary to determine the value of your claim.

You may have a product liability claim against K-Mart, and the manufacturer of the chair. The value of your case would be calculated based on a number of factors, such as how you have been effected; both currently and in the future. My background is in civil litigation. You likely have a claim against KMart, the manufacturer and poissibly everyone in the chain of commerce for selling a dangerously defective product (products liability suit). You obviously have some serious damages but to fully evaluate what your damages are, it is necessary to look at all of your medical bills, loss of income, and of course the potential future damages of your inability to perform certain tasks or work.
In addition, if you are married, your wife and/or kids may have a claim.
