Legal Question in Personal Injury in Ohio
Auto accident injury awards.....
Last year my wife was injured in an auto accident in which the other party( a company car) was declared at fault in the police report. She had neck pain for several days, went to the emergency room and a follow up. The pain was still there and finally an mri was performed. The
mri report concludes that there is a) central disc protrusion and b) cervical sprain/strain, both small.
The insurance company has offered $700 (pain and suffereing) + medical expenses to settle this claim.
They say she has had very little in the way of actual treatment and so nothing further in the form of future medical expenses should be expected. We did not claim any time lost on work, etc. In addition, the insurance did fix her car as well.
Is this a fair settlement ? If not, what would be ?

The settlement offer is not sufficient. You need to retain an attorney and an expert to assist you in the claim.

This does not sound like a fair settlement offer to me. Of course I haven't reviewed your wife's medical records, but a disc protusion is a serious matter. Don't settle this case without first speaking to an attorney. Please feel free to contact me at 216.241.2500 for a free consultation.

The insurance company is not offering enough money based on the severity of the injury. Contact a lawyer immediately to protect your rights.
