automobile accident - settlement

I was involved in an automobile accident where I was struck from behind. The other driver was found to be at fault. The at fault driver is covered by the same insurance company as I am. I received injuries to my neck and lower back that the doctors have described as ''strains''. I have waited for 8 months to be certain that no permanent injuries had occurred, in that time I have had recurring minor pain and stiffness in my lower back. I would like to know what would be fair compensation for pain and suffering so that when I discuss settlement I can decide if I need legal representation.

There really is no way to acertain what would be a fair settlement without knowing the specifics of your case. How much were your medical bills? Did you mis time from work? What reoccurring problems will you have? How bad was the other person's conduct? All these things come into play. Full and fair compensation is what you are seeking. The factors to be taken into consideration are permanency of injury; loss of wages; pain and suffering; medical expenses; future pain and suffering; and a number of other factors. Each personal injury case is different. There is no formula to determine what is appropriate without a full evaluation of the case. Some lawyers will say that you can count on three to five times your medical bills. That is not always good advice and does not always provide full and fair compensation to a client.
