Legal Question in Personal Injury in Ohio

I was bitten by a friend's dog and I required surgery. My health insurance has covered the medical expenses ($3000). I've paid co-pays, medication, bandages and tape, etc. My friend's homeowners insurance sent me a check for $1000, which they claim is the maximum benefit under her medical clause. Should I cash this check ?

I would hold off cashing the check, as that may be construed as accord and satisfaction of the entire amount owed to you. Just last week, the Ohio Supreme Court issued a decision that strengthened the rights of people asserting dog bite injuries. There are probably other insurance coverages available.
